Welcome to PostHelp. These Terms of Service (“Terms”) govern your access to and use of the PostHelp website (posthelp.ai), WordPress plugin, and all related services (collectively, the “Service”) provided by Sitez Incorporated (“we,” “us,” or “our”). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

Eligibility

You must be at least 18 years of age to use PostHelp. By using the Service, you represent that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are using PostHelp on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms.

Account Registration

To use PostHelp, you must create an account during checkout. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate and complete information during registration and to update your information as needed. You must notify us immediately if you suspect unauthorized use of your account.

Service Description

PostHelp is an AI-powered tool that generates social media post captions from photos and business context. You upload a photo, provide optional text input, and PostHelp uses the Anthropic Claude API to generate platform-specific captions for your use on social media. PostHelp writes posts — it does not schedule, publish, or manage your social media accounts on your behalf.

Subscription Plans and Billing

Plans

PostHelp offers a free trial and paid subscription plans. Each plan includes a monthly generation allotment that resets on a rolling 30-day billing cycle tied to your subscription start date. Plan details, pricing, and generation limits are described on our website and may change from time to time.

Billing

Paid subscriptions are billed through Stripe via WooCommerce. By subscribing, you authorize us to charge your selected payment method at the applicable rate on a recurring basis (monthly or annually, depending on your selected billing period). Annual plans are billed upfront for the full year.

Generation Add-Ons

Paid subscribers may purchase additional generation credits as one-time add-ons. Add-on credits do not expire and are consumed only after your monthly allotment is used. Add-on purchases are non-refundable.

Free Trial

The free trial provides a limited number of generations at no cost and does not require a credit card. Free trial users are subject to feature restrictions as described on our website. The free trial is limited to one per person.

Content Ownership and License

Your Content

You retain full ownership of all photos, text, and other content you upload to PostHelp (“Your Content”). By uploading content, you grant Sitez Incorporated a limited, non-exclusive license to process Your Content solely for the purpose of providing the Service — specifically, to send it to the AI for caption generation and to store it for your post history.

Generated Content

You own the captions and posts generated by PostHelp. You are free to use, edit, and publish generated content on any platform without restriction. However, you are solely responsible for reviewing generated content before publishing it. AI-generated content may contain errors, inaccuracies, or inappropriate language, and you assume full responsibility for anything you publish.

Our Intellectual Property

The PostHelp name, logo, website design, plugin code, and all associated branding are the intellectual property of Sitez Incorporated. Nothing in these Terms grants you any right to use our trademarks, branding, or proprietary materials beyond normal use of the Service.

Acceptable Use

You agree not to use PostHelp to:

• Upload content that is illegal, obscene, defamatory, threatening, or that infringes on the rights of others.
• Generate content intended to harass, deceive, defraud, or mislead others.
• Attempt to bypass generation limits, manipulate your account, or exploit the Service in any unauthorized way.
• Use automated tools, bots, or scripts to access the Service beyond its intended interface.
• Reverse-engineer, decompile, or attempt to extract the source code of the plugin or Service.
• Resell, sublicense, or redistribute access to PostHelp without written permission.

We reserve the right to suspend or terminate accounts that violate these terms, with or without notice.

AI-Generated Content Disclaimer

PostHelp uses artificial intelligence to generate social media captions. While we strive to produce high-quality, relevant content, AI output is inherently unpredictable. We do not guarantee the accuracy, appropriateness, or fitness for any particular purpose of any generated content. You are responsible for reviewing and editing all content before use. PostHelp and Sitez Incorporated are not liable for any consequences arising from your use of AI-generated content.

Cancellation and Refunds

Cancellation

You may cancel your subscription at any time. Upon cancellation, you will retain access to the Service through the end of your current billing period. No further charges will be made after cancellation takes effect.

Refunds

Monthly subscription fees are non-refundable. For annual plans, if you cancel within 14 days of your initial purchase and have used fewer than 10 generations, you may request a full refund by contacting us. After 14 days or 10 generations (whichever comes first), annual fees are non-refundable. Generation add-on purchases are non-refundable.

Service Availability

We strive to keep PostHelp available and operational, but we do not guarantee uninterrupted or error-free service. The Service may be temporarily unavailable due to maintenance, updates, or factors beyond our control, including third-party service outages (such as the Anthropic API or Stripe). We are not liable for any loss or inconvenience caused by service interruptions.

Limitation of Liability

To the maximum extent permitted by law, Sitez Incorporated and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of PostHelp, including but not limited to loss of revenue, data, or business opportunities. Our total liability for any claim related to the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

Disclaimer of Warranties

PostHelp is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will meet your expectations or that generated content will be suitable for any specific use.

Indemnification

You agree to indemnify and hold harmless Sitez Incorporated and its officers, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable attorney’s fees) arising from your use of the Service, your violation of these Terms, or your publication of content generated through PostHelp.

Governing Law

These Terms are governed by the laws of the State of Colorado, United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in El Paso County, Colorado.

Changes to These Terms

We may modify these Terms from time to time. When we make material changes, we will update the effective date at the top of this page and may notify you by email or through the Service. Your continued use of PostHelp after changes are posted constitutes acceptance of the updated Terms. If you do not agree with the updated Terms, you must stop using the Service.

Termination

We reserve the right to suspend or terminate your account and access to PostHelp at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Sections of these Terms that by their nature should survive termination will remain in effect, including ownership, indemnification, limitation of liability, and governing law.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Sitez Incorporated regarding your use of PostHelp. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
